Welcome

The number looked sort of familiar to me, and it is, as I've seen this on newsgroups but not taken much notice

Looking on Google, it appears to be from a company called Data Partnership Solutions on behalf of an associated satellite TV operation called Satcover.

They don't seem to respect TPS registration, claming that it is not direct marketing but a survey

Which is rather odd, as this was in the Daily Mirror
http://www.mirror.co.uk/news/mirrorinvestigates/tm_column_date=19052005-name_index.html

Quote:
SINK THIS 'SKY' SUBS COLD CALL
SKY subscribers beware, if you haven't had a call from Subscriber Services yet you will soon.

The company makes 25,000 cold calls a week, each one starting: "Hello, I'm calling from Subscriber Services regarding the manufacturer's warranty on your Sky television system, which has expired."

The sales rep, on a fiver commission for each new client, then tries to sell a warranty for £65 a year.

But the caller is not actually from the satellite broadcaster, but an outfit that trades as Satellite Direct UK, Satcover, HomeCare, Skycare Service Agreements and Subscriber Services.

It claims more than 400,000 clients, including Judy Brooks of Wakefield, West Yorks, who insists: "They said they were part of Sky Digital."

When her system broke down, she phoned Sussex-based Satellite Direct, only to be told that it couldn't get an engineer to her for three weeks.

Then she called Sky, which said it would have fixed it the next day.

Subscriber Services and its sister companies are owned and run by 40-year-old David Reynolds, driver of two Lexus cars with personalised plates.

He blamed the delay in reaching Judy on sub-contracted engineers.

"We have rectified all the problems by employing our own engineers and the call-out time in that area is one to two days," he told us.

But could his staff's sales pitch mislead people into thinking the call is from Sky itself?

"If somebody says they are unhappy, if they tell us they took out our warranty by mistake or that we are not who they thought we were, we give a full refund," he pledged.

Title: 0870 2402559 scam call
Post by Keith on Nov 28th, 2006 at 4:00pm
As I'm TPS registered I reported the following scam:

I rec'd a recorded message telling me I had won  free flights to Turkey and to call 0870 2402559 (which was also the number they used to call me). This is
not the first time I have rec'd this call and I assume it is a scam by
generating revenue when you call the 0870 number.

The message also advertised playradiouk.com which I looked up on the
internet and does exist. I tried calling the number shown on the web site
but they were all engaged.

Pretty sad replying to my own post I know ;D , but I just typed the number into Google and got 133 entries. Lots of discussion on this number and lots of comments about the various authrities doing nothing about it!!! We shall see if my TPS report gets acted upon. Do they let you know?

I see that this number was already discussed and my post has been moved under the original heading - Thank you.

What is clear is the message has completely changed (free holidays rather than SatCover) and its another typical scam topic (the free holiday if you call this number scam)

I also note that another scam has been highlighted today where you call an 0871 number for your messages

It is clear that people aren't falling for the 09 numbers so easily whereas the 08 numbers are an easier trap, people being less knowledgeable.

Surely the fact that scammers are now commonly doing this is a powerful argument for doing something about these numbers. It is difficult to argue that they aren't an abuse when obvious criminals jump on the bandwagon

Maybe the one firm does its telemarketing on behalf of several clients

The trouble with TPS compliance is that telemarketing firms have to pay to get the database of opted-out callers, so the least ethical ones just don't bother to subscribe.

Maybe some action should be taken against certain firms offering a load of complacent crappy excuses, like lying that it's a survey not sales, why they disrespect the law on these issues

the company running the call center is data partnership solutions based in yapton sussex the automated system generates random numbers and uses a text to speech and automated speech recognition. the reason tps dosnt stop the calls is because they aint selling nothing.  (dps is the second largest warranty repair company of sky digital systems in the uk!)

many of these call centeres work on behalf of many big companies (such as sky) and arnt breaking any laws (as the number isnt premium rate)

Welcome

The legality doesn't turn on whether the number is premium rate

The point is, if people have registered with the Telephone Preference Service, this means they do not want unsolicited sales phone calls from organisations they have no association with.

If you follow a couple of links in my earlier post, this firm makes so-called market research calls, then follows them up with sales calls, and makes pathetic excuses when questioned about TPS compliance - in other words they treat the whole subject with contempt.

The other day I spoke to a telecoms company about the use of one of their numbers

I commented jokingly about such cases as this, where the market-research survey might be to find out what proportion of recipients would report subsequent unsolicited sales calls to the TPS.

You are either naive or biased. DPS is acting for (or is?) Satcover who are selling extra warranty insurance for satellite TV installations (which according to a couple of easy-to-find sources some customers have found rather less effective than calling Sky themselves) - see my post above, quoting a national newspaper

Have just had an automated call from this lot, interesting as we have NO satellite equipment (and would, indeed, need planning permission before we could get any) so where did they get my number, bearing in mind we are TPS registered and have been for YEARS?!   Anyway, I found a email address for them and complained and also logged a complaint via TPS.   I think I read in another thread that the more complaints that are made about these types the better.   Do I need to complaint to anyone else?

For info, have had very prompt reply from Satcover following my email complaint asking for my details so that they can "remove me from their mailing list"!   As I am also registered on the MPS, I don't trust this & believe they will ADD my details if I supply them.  I have request a geo tel no for a senior member of their staff so that I can call them to check their bona fides before I release any details.  Does anyone have any further info on this lot as I am very suspicious.

I just received an automated call from this mob.  You don't need to quote TPS as what they are doing is illegal (see below for the relevant legislation).  However, don't call them back to complain, that'll generate them more revenue.  Instead, you need to find the Information Commissioners website, download a complaints form from http://www.ico.gov.uk/complaints/privacy_and_electronic_communications.aspx, fill it in, save it and send it in to the Commissioner using their enquiry submission form to be found at http://www.esd.informationcommissioner.gov.uk/esd/genenq.asp

Here's the relevant bit of the Privacy and Electronic Communications (EC Directive) Regulations 2003, which came into effect at the end of 2003:

19. (1) A person shall neither transmit, nor instigate the transmission of, communications comprising recorded matter for direct marketing purposes by means of an automated calling system except in the circumstances referred to in paragraph (2).
(2) Those circumstances are where the called line is that of a subscriber who has previously notified the caller that for the time being he consents to such communications being sent by, or at the instigation of, the caller on that line.

...

For the purposes of this regulation, an automated calling system is a system which is capable of -

(a) automatically initiating a sequence of calls to more than one destination in accordance with instructions stored in that system; and

(b) transmitting sounds which are not live speech for reception by persons at some or all of the destinations so called.
