Agenda Item (2): Review of minutes of previous meeting

Proposed amendments received from Ofcom were circulated the same day for review by 17/01/2008 .

All to review amended minutes of the December 07 meeting and contact the Chair in case of disagreement by 17/01.

Agenda (3): Update / progress report on the current 'live' NTS related consultations / investigations: (Ofcom/All)

Review of Regulation of Premium Rate Services

CH stated that the consultation should be issued in Q1.08, although there is a delay due to the departure of B. Brady and general resources issues.

CH also mentioned the statement issued by Ofcom in December in relation to the new arrangements between PP+ and Ofcom, and the appointment of an Ofcom representative to the board of PP+.

CH said that Ann Hoitink had been appointed project manager for the review.

DJ asked what the consultation would cover. CH responded the object was primarily the scope of the review, as well as pricing and transparency.

NCCN 500 investigation / NTS call termination market review
CH confirmed that the first round of meetings with respondent to the draft decision had taken place in December. A second round of meetings will take place in January to discuss certain points in more detail.

General Condition 14 Enforcement Programme
CH confirmed that the programme is ongoing but is subject to resources issues in the investigations team. MB remarked that the scope had been extended.

Delay to 0870 implementation
GB stated that he had finalised a submission on revised proposals for 0870 which will be put to the Ofcom Board on 15/01/08.

DJ asked for clarification of the timescales.

GB explained that the 0870 consultation would be published as soon as possible after the Board decision although it was not possible to give any precise timescale at this time. The consultation will run for 6 weeks after which the large volume of responses expected would have to be reviewed. A final statement is unlikely to be published before late spring /summer 08.

AW asked Ofcom to confirm whether the consultation could cover matters of policy. CH responded that it would if it was thought that changes were required.

TH queried the status of applicable POLO rates past March 08 following the withdrawal of the 1 st February price change by BT. SH responded that it was dependent on the outcome of the dispute.

CS queried the timescale for implementation. GB responded that this was dependent on the extent of any policy changes and that time will be allowed to enable telecoms and service providers to make any changes to their implementation plans.

Agenda (4): Delay to 0870 Dispute Determination

LP explained that operators were finding it increasingly difficult to manage customers expectations and asked whether Ofcom would consider issuing a statement explaining the current situation and the likely timeframe for implementation of changes to 870. CH noted that Ofcom had already issued a notice of the delay and indicated that the consultation would provide the necessary clarity about the next steps.

AM asked about the expected timeframe for completion of the 0870 termination dispute. GB explained that the determination of the dispute had been suspended pending the outcome of a Competition Appeals Tribunal hearing into Ofcom’s Mobile Call Termination Review. The timing was unknown but the decision is expected in February or March 2008.

CS asked what would happen if the CAT does not endorse the Gains from Trade test arising from the End-to-End Connectivity obligation. GB said that this depended on whether the CAT gave any guidance as to the appropriate alternative methodology. If not Ofcom would have to reconsider how to proceed with the dispute. This possibility was a highly undesirable scenario.

DJ stated that with the uncertainty surrounding 0870 there was no incentive for customers to migrate. Yet a reasonable notice period is required for any changes and e.g. 3 months might be too short and asked Ofcom to put some thoughts into this issue. GB confirmed that the consultation would also propose an appropriate implementation period which would depend upon the extent of any changes to the published policy.

DJ also reiterated the difficulty of explaining the reasons for the delay, which CH acknowledged is an issue for all, including Ofcom.

CR asked about the timing for 0871 changes. CH explained that were no hurdle there and those should be finalised in the next few weeks, dependent on the availability of resources.

GB said that the timing of implementation would take account of the timescales for completing the dispute. Clearly until the new rates were in place the changes could not go ahead.

AM asked if changes could take place before the summer. GB said that this was looking unlikely.

CS asked whether the CAT may propose a different methodology. GB said that this was possible but if the CAT simply rejected Ofcom’s proposal without offering an alternative it would delay the dispute and put Ofcom in an awkward position.

Agenda (5): 070 pre-call announcements

LP explained that Flextel had forwarded a correspondence with Ofcom in relation to the use made of 070 numbers to the chair and asked for this item to be put on the agenda. GB explained that Ofcom took the view that this matter is outside of the remit of this group as 070 is not an NTS service. All agreed however that the issue of pre-call announcement is relevant insofar as it applies to 0870.

CG asked when the consultation would take place. CH said that it would be issued as soon as possible.

AM asked if BT would withdraw its OCCN following the suspension announcements. SH replied that development costs had been incurred and that rates will be reviewed once those costs have been recovered. CS pointed that all operators have incurred costs but unlike BT were not able to recover their costs in the same manner.

Agenda (6): Implementation of the 03 Ranges (Ofcom/All)

Ofcom confirmed that they had not received any disputes regarding 03 termination rates.

LP asked BT had received / responded to Kingston’s OCCN mentioned at the last meeting. SH replied that he didn’t have any information on this.

Agenda (7): International Access to 0844/0871 (BT/All)

Action Sep07_04 : All international carriers to confirm their plans for making international access available for 0844 and 0871.

Action Dec07_02: JH to write to all international carriers regarding their plans to open international access to 0871 and 0844.

The letter will be sent shortly and recipients are invited to respond by the next Focus Group meeting.

Action Jan08_02: All recipients to respond to the letter from the Chair re international access to 0844/0871.

SH confirmed that BT has asked overseas operators to open UK 03 ranges ad added that the service would be available once BT had finalised POLO rates for international incoming calls and subject to operators submitting DMA requests. SH stated that proposed rates should be available at the end of the month, and an international access option added to the DMA request form.

CS asked why the payment arrangements should be different from national incoming. He stated that there was no ground for the rates to be different from national incoming as per an Oftel decision in relation to 0870/0845.

LP asked whether BT to present the rationale for the approach at the next meeting should they decide to apply differentiated rates.

Action Jan08_03: BT to present at the next Focus Group meeting the rationale for POLO rates for international incoming 0844/0871 should these differ from national rates.

Agenda (8): Review of remaining action points

Action Aug06_09: Porting differential issue to be added to the agenda of the first NTSFG meeting of 2007.

ó Ongoing, pending resolution of NCCN500 dispute. LP suggested changing the year to 2009

Action Sep07_01: ICSTIS to provide more detail on the levy calculation.

CH said this should have been discharged after the least meeting. CR pointed that there was not enough information available and asked Ofcom to cover this in the 0871 consultation. Ongoing

Action Sep07_02: ICSTIS to inform Focus group when consultation responses are available on the ICSTIS website

CH stated the responses were on the website. Some operators said they had difficulty finding them [link was provided shortly after the meeting: http://www.phonepayplus.org.uk/service_providers/responsestoconsultations/0871ne... ]

Action Dec07_01: Ofcom to confirm all minutes up to the October 2007 meeting have been uploaded on the Ofcom website.

LP asked BT when the new POLO rates for the year 2008-09 would be issued. SH replied that these should be out by end of January / beginning of February. LP asked whether BT would present the content of the changes at the next Focus Group meeting. SH said that BT would consider it if changes were made to elements in the formula other than the conveyance components.

I suspect that CH is not an accountant as he does not refer to Q1.08 as being in the past.

For an accountant Q1.08 ran from April to June 2007 (the first quarter of the year ending 31 March 2008).

For others it is probably from April to June 2008 (the first quarter of 08/09).


With two reasons for a delay one is being a little optimistic in asking the question now.
